About Eleanor

Elly Andrews is a senior associate in the Development Risk team, with particular expertise in rights of light and neighbourly matters. She has experience advising developers, housebuilders and housing associations on rights of light risk mitigation strategies, including the use of light obstruction notices, insurance solutions, and negotiated releases. Elly also advises on other neighbourly issues including rights of way, prescriptive easements, and boundary matters.

Recent Experience:

  • Advising a number of national house builders and G15 housing associations on significant regeneration schemes with respect to their rights of light risk mitigation strategy which includes:
    1. Strategic advice based on the risks presented by each scheme;
    2. Negotiating rights of light insurance policies;
    3. Dealing with and negotiating rights of light releases; and
    4. Dealing with rights of light claims.
  • Advised on and arranged the successful service of c. 3,000 light obstruction notices to protect future development against rights of light claims.
  • Successfully represented a developer in a village green inquiry, securing a positive outcome and enabling the proposed development to proceed.
  • Advising landowners on easements, landowner statements and defending public footpath applications across land to be developed in the future.
  • Advising landowners next to developments on their rights and negotiating neighbourly matters agreements on large scale developments.
  • Advising clients on New Homes Ombudsman claims and strategy for seeking to reduce claims.
  • Experience in advising clients on more unusual property issues such as bona vacantia, adverse possession claims and ad medium filum.
