Case Study: Complex ET Claims

The team have extensive experience in successfully defending employment tribunal and civil claims. Recent examples include:

  • Acting for a Church of England school and six named individual respondents (including the Headteacher and Chair of Governors) in a claim involving a myriad of allegations including unfair dismissal, wrongful dismissal, whistleblowing, disability discrimination, failure to make reasonable adjustments and personal injury. Following a 20 days final hearing we successfully defended approximately 170 separate allegations of discrimination against all Respondents.
  • Acting for a Multi-Academy Trust in defence of a complex employment tribunal claim by a former Teacher who had been timetabled to teach classes outside of their specialist subject area. The Claimant argued that this was a breach of contract, and that the decision to deploy them outside of their specialist subject area was because of their age and their race. The claim also included claims of unfair dismissal, harassment and victimisation spanning a number of years, with some allegations dating back almost a decade ago. We secured dismissal and/or strike out of the majority of the claims of race discrimination, and deposit orders for the age discrimination and harassment claims. Part way through the final hearing, the Claimant withdrew all remaining claims, and the case was dismissed by the tribunal in its entirety.
  • Acting for a client in the successful defence of a county court claim for damages arising out of a job reference.
  • Acting for a Catholic VA school in successfully securing strike out of a number of vexatious claims brought by a group of disgruntled employees. In addition, we secured a £20,000 costs order in the school’s favour setting a clear example to the other claimants and deterring them from any further vexatious claims.

Acting for a client in the successful defence of an unfair dismissal claim relating to a redundancy and restructure at a school following the implementation of an Executive Interim Board.
