Some of the provisions of the Charities Act 2022 came into force yesterday (14 June 2023). The provisions cover: advertising and report requirements; advice relating to the disposition of charity land; advice from charity trustees, officers and employees; and residential leases granted to employees. The provisions relating to charity to charity dispositions are not in force yet and will come into force later this year.
Charity trustees now need to be working with these revisions in mind. Although the government’s stated aim was to make disposals easier and cheaper for impecunious charities, in practice the changes may make little real difference, save in relation to cost, as it is likely to remain the most prudent and transparent course of action that charity trustees obtain and consider advice in writing from a competent designated adviser with the requisite experience.
