The team supported a client through a sensitive grievance process involving complex allegations of disability discrimination and failures to make reasonable adjustments. We supported with the careful management of the investigation process, ensuring at all times compliance with the relevant Trust policies as well as the Acas Code of Practice on Disciplinary and Grievance Procedures and Acas guide to investigations at work. We called upon our database of trusted independent investigators, prepared the terms of reference, and advised the Trust on navigating concurrent formal procedures, including long-term sickness absence management and a restructure consultation. Following the investigation and grievance hearing, we supported the Trust with a robust outcome letter dismissing the grievance. When the employee appealed the outcome, we continued to provide strategic support – this time by supporting the appeal panel. After a thorough hearing in which the panel was asked to consider a vast number of submissions and documents, the appeal was dismissed in full.
