About Emma

Emma is Head of Litigation and leads the property dispute resolution team. Emma’s expertise is in litigating and providing advice on development risk, commercial property asset management and residential management. She is also a Solicitor Advocate and former barrister.

Emma advises on development risk facilitating acquisition or disposition of land including trespass, boundary disputes and restrictive covenants, adverse possession as well as development contract disputes. She is regularly instructed on commercial property estate and asset management including disputes or advice on commercial service charges, contested lease renewals, dilapidations, forfeiture, breach of lease covenants and property related insolvency issues. Emma also advises on large service charge disputes and procurement of major infrastructure and consultation. Emma’s clients are housebuilders and private developers, registered social landlords, charities, pension funds and other private clients and businesses.

Recent Experience

  • Advising a registered provider on securing favourable terms of exit from a development agreement
  • Acting for a fund on a service charge dispute before the First tier Tribunal involving complex issues of management and provision of services and tax issues
  • Acting for a private developer in a high value dispute regarding alleged breach of the sale and development agreement
  • Acting for a landowner on injunctive relief to enforce a restrictive covenant
  • Acting for a charity in respect of asset management advice regarding its commercial and residential property portfolio involving listed and heritage buildings
  • Advising a developer on its residential management obligations on a major London development
  • Advising a landowner on a claim against a developer for breach of contract in late delivery of infrastructure
  • Acting for a developer in a claim for dispensation from consultation in provision and procurement of significant amenities at a key London development
  • Advising a developer / landlord on commercial property asset management
  • Advising a private client on injunctive and other relief to prevent trespass on an estate with public access
