Richard has worked in a large number of property related areas including:

 

  • commercial property acquisitions and disposals, lettings, lease renewals and restructurings, and other landlord and tenant/portfolio management matters; acting for business occupiers in office relocations/new lettings, lease renewals etc
  • development/redevelopment sites, including site acquisition/assembly work, easements, covenants, rights of light etc, leases for development/redevelopment, and VAT implications of development schemes and some experience of construction documentation e.g. appointments, warranties, construction contracts, etc
  • residential property acquisitions and disposals, lettings and other residential landlord and tenant transactions including advice on Rent Act tenancies
  • charging portfolios of commercial and residential properties including advice on the terms of finance agreements
  • dealing with disputes at the Land Registry Adjudicator including claims to title by way of adverse possession and easements acquired by implied rights or prescription and disputed rights to land generally
  • leasehold enfranchisement (including 1967 Act freehold enfranchisement and lease extensions, 1993 Act collective freehold acquisitions and individual lease extensions)
  • technical advice on aspects of stamp duty land tax including group relief and implications for partnerships

Recent Experience

Recent transactions in which Richard has been involved include:

  • acting for a large naval charity in property aspects of a major regeneration programme in South East London
  • acting in relation to negotiation and grant of leases of buildings in Greenwich including lease re-organisations
  • acting in the grant of leases and easements and disposals for a significant religious  charity and their development of sites with residential developers including advice on whether the charity’s constitution permitted the same
  • acting in the purchase of agricultural land in accordance with the Crichel Down rules
  • defending an adverse possession claim at the Land Registry adjudicator in respect of valuable fallow land with a disputed title possibly having passed bona vacantia
  • charging a set of hotel leases as part of a refinancing exercise
  • acting for a Russian bank in respect of its relocation of offices
  • acting for a theatre producer  in respect of its relocation of offices
  • advice in respect of SDLT avoidance schemes
