Employment Tribunal Case Study: strike out and costs order

We acted for a school with a religious character in successfully securing strike out of an employment tribunal claim brought by a disgruntled former employee. The Claimant had conducted themselves in an unreasonable and disruptive manner throughout proceedings, putting our client to unnecessary time, stress and cost. The Claimant repeatedly breached tribunal orders and failed to attend a number of hearings resulting in their claim eventually being struck out. Not only was the claim struck out, the Claimant was also ordered to pay a proportion of our client’s costs due to their unreasonable behaviour.
