About Jane

Jane is a highly regarded member of the Parliamentary and Infrastructure team. She practiced at the common law bar for 5 years and spent 14 years in industry before joining Winckworth Sherwood. Since joining the Parliamentary and Infrastructure team in 2006, Jane has gained experience across virtually every aspect of our practice.

Jane’s hybrid Bill experience has encompassed the following:

Jane has also advised on the implementation of the Midland Metro Orders, the application of bye-laws and the statutory powers of the West Midlands Combined Authority.

Heritage rail

Jane has experience of advising on all aspects of the application process and has either led or assisted on the following successful promotions:

  • Chinnor and Princes Risborough Order 2021
  • Cambrian Railway Order 2017
  • Swanage Railway Order 2014
  • Nene Valley Railway (Fletton Branch) Order 2012

Jane also advises heritage railways on the requirements for transferring their statutory undertakings where no further order is required and is regularly asked to provide advice as to whether or not statutory powers are required for specific projects.

Development Consent Orders

Jane has experience of advising on the following DCO applications:

  • Able Marine Energy Park Order 2014 (objection on behalf of Humber Harbour Master and attending hearings);
  • East Anglia One Offshore Windfarm Order 2014 (securing asset protection agreement and protective provisions on behalf of Network Rail);
  • Thames Water Utilities Limited (Thames Tideway Tunnel) Order 2014 (securing asset protection agreement on behalf of Royal Mail)
  • North Blyth Biomass Power Station Order 2013 (securing asset protection agreement and protective provisions on behalf of Network Rail);
  • Network Rail (Ipswich Chord) Order 2012 (promotion on behalf of Network Rail).

Ports and harbours

Jane has acted for the Harbour Master Humber in relation to the Able Marine Energy Park DCO and, more recently, on behalf of the Newport, Cardiff and Barry Port Security Authority in relation to the proposed extension of the M4 around Newport.

Jane assisted on a review of ports and harbours bye-laws on behalf of Associated British Ports and has also provided advice on the statutory status of ABP Garston and proposed guidance on dredging third party areas within statutory harbour areas.

Jane recently advised a statutory harbour authority in relation to the re-financing of its statutory undertaking, including a review of relevant legislation and governance requirements.

Private Bills

Jane assisted on the successful promotion of the Beverley Freeman Act 2010 which extended the categories of persons entitled to by birthright to be enrolled as a Beverley Freeman so as to extend entitlement to the daughter of a Freeman and to any person born before the Freeman parent became a Freeman, made entitlement to be enrolled as a Pasture Freeman dependent upon residence in an extended area that includes the whole of Beverley as it presently exists and modifed the Beverley Common Pastures Act 1836 and the 1813 Order to reflect these changes.
