School leaders have had a busy start to the academic year, navigating the challenges of making schools COVID secure, welcoming pupils back to the classroom after a long absence, and dealing with the aftermath of the GCSE and A Level results. Schools will also have had new pupils join them in September, and as half term approaches it will be increasingly clear that in some instances those new pupils have additional needs that may be difficult to provide for. Additionally, as the phase transfer process commences once again for pupils moving between key stages, this can be a particularly challenging time for secondary schools who are consulted in relation to current Year 6 pupils with EHCPs if they consider that they cannot meet the needs of the pupils they are being asked to take.
Our Education team has particular experience in dealing with a range of issues relating to children with special educational needs including exclusions, defending disability discrimination claims, challenging being named in an EHCP and other situations that arise in relation to providing for children with SEN. Our SEN team, Laura Martin, Tracey Eldridge-Hinmers and Stephanie Hughes, regularly advise mainstream and special schools in both the maintained sector as well as academies. We also have experience in acting for local authorities and understand the challenges faced in relation to funding for pupils with SEN.
